Definitions
Seller - MDL Ltd., with registered office at 10 Lege Street, Floor 2, Sofia, entered in the Commercial Register of the Republic of Bulgaria with UIC 130820763, MOL: Boryana Borisova, telephone number: +359 884 381 201, email address: +359 884 381 201, email address: shop@mdl.bg; other means of communication with the customer: (https://www.facebook.com/MDLLuxury, https://www.facebook.com/mdlgroupltd;)
Website address on the Internet luxury.mdl.bg, as well as all applications providing the customer with access to the catalog of items offered at the specified address.
Customer - any person who has visited the website and/or used the Services or its content.
Buyer - any customer of the Website who is over 18 years of age and has provided a delivery address within the territory of the Republic of Bulgaria and who has made a payment to the Seller.
Profile—standard username and password chosen by the customer, providing them with access to all goods and services offered on the website, as well as the ability to exchange information with the Seller.
Order - a request from the Buyer to purchase goods and services offered on the Website that they have previously selected. For the avoidance of doubt, only requests with a delivery address within the territory of the Republic of Bulgaria shall be considered orders.
Distance contract – an order placed by the Buyer with the Seller for goods offered on the Website. For the avoidance of doubt, individual orders are treated as separate contracts.
Services – the provision of any electronic services by the Website to enable the Customer to communicate with the Seller and/or purchase goods offered in the Website catalog.
Electronic voucher - a random combination of letters, numbers, and symbols. The combination thus created is sent by the Seller to the Buyer if the latter decides to purchase an electronic voucher. The electronic voucher provided to the Customer is equal to the amount paid by the latter. The electronic voucher can be used once and within a period not exceeding 1 month from the date of issue. When using an electronic voucher, the amount of the voucher already paid is deducted from the amount of the Order.
Promo code - any mix of letters, numbers, and symbols that lets the Customer get a fixed and/or percentage discount on the Order. Promo codes are provided by the Seller to the Customer via email to the address specified by the latter or via a banner on the website, valid for one calendar month.
Free shipping - For orders over 99.00 (ninety-nine) leva, the shipping costs are covered by the Seller. Shipping is done by a courier company to the address given by the Buyer.
Paid delivery - In case of an order worth less than 99.00 (ninety-nine) leva, the Buyer shall pay for the transport of the ordered goods and services. Transport shall be carried out by a courier company to the address specified by the Buyer. For the avoidance of doubt, the delivery costs are a fixed amount of BGN 3.99 (three levs and ninety-nine stotinki), including VAT, regardless of the volume and/or weight of the shipment.
Courier - orders placed through the Website are delivered by the courier company "Speedy" AD. More information about the courier company can be found here:
Receipt of order - the date on which the delivery was made to the address specified by the Customer.
Shopping cart - a virtual list of items selected for purchase by the Customer.
Final price - all costs incurred by the Buyer for the purchase of the goods, including the cost of Delivery. For the avoidance of doubt, in cases where the Customer uses free Delivery, the same shall not be calculated and shall be borne by the Seller in accordance with these GTC.
Virtual POS terminal - a system for payment by debit and credit cards implemented on the Website. The information used for payment through the POS terminal is processed solely by the bank.
General provisions
With these General Terms and Conditions, the Seller, represented by the company "MDL" LTD, declares that it complies with all applicable national regulations regarding the protection of personal data of customers and buyers and processes such personal data in accordance with its personal data protection policy, which you can find and read here.
Access to restricted areas of the Website becomes active after registration or logging into your Profile. Registration is completed by the Customer filling out a standard form published on the Website. Direct access to the registration form can be found here.
Access to the Website may be blocked unilaterally and without notice if it is found that the Customer is misusing the content and/or goods and Services provided on the Website.
Upon registration, as well as upon confirmation of each Order placed, the Buyer confirms that they have read and accept these General Terms and Conditions.
All prices in the Website catalog are in Bulgarian leva, for one item/pair of each item listed.
The Seller shall endeavor to maintain an up-to-date price list, while reserving the right to renew or terminate any additional discounts/promo codes and games provided at any given time, without having to notify the Customer of any changes.
Any reduction in the prices of goods shall be made by the Seller in accordance with the principles and norms of Articles 63-66 of the Consumer Protection Act. MDL Luxury does not individualize the prices of the goods offered based on automated decision-making in connection with the automated processing of personal data of Customers/Consumers/Buyers.
The ranking of goods according to specific search parameters set by Customers/Consumers/Buyers is carried out by MDL Luxury in the following way:
The Customer defines the criteria by which the products are displayed in the general product catalog and can use a filter to determine the sorting criteria. The options by which the Customer's already defined selection can be displayed are as follows: discounted items ("Sale"), "Recommended", by date - Ascending order, by date - Descending order, by name - Descending order, by name - Ascending order, by price - Ascending order, by price - Descending order, by default.
MDL Luxury and our physical locations make every effort to maintain the accuracy of the information presented on the Platform. The Seller complies with all requirements of the applicable legislation regarding ensuring the conformity of the goods with their description, qualities, and characteristics.
The characteristics or prices of the products described on the Platform may be changed by the Seller at any time.
The Seller reserves the right to amend and update these General Terms and Conditions (GTC) unilaterally and without prior notice to the Customer. For the avoidance of doubt, by confirming any Order, the Buyer declares that they have read and accepted the General Terms and Conditions published on the Website on the date of the Order.
The Customer agrees that it is permissible for there to be a difference between the prices advertised on the Website and those in the Seller's stores in the country.
The website uses data officially provided by the manufacturer regarding the color range of the goods offered in the catalog. The customer agrees that differences in color between the delivered and ordered goods are acceptable, given that the colors seen in the photos depend on the customer's computer configuration and visual perception.
The website accepts orders only if the Customer provides a valid delivery address within the territory of the Republic of Bulgaria.
Confidentiality
The Customer/User/Buyer agrees that by providing any personal or other data to MDL Luxury, they consent to its use by MDL Luxury for the following purposes: (1) maintaining the Customer/User/Buyer's account, including registering orders, shipping ordered products, performing ordered services, invoicing, resolving disputes with Customers/Users/Buyers regarding their Orders or reviewing their requests;tion confidential, unless required to do so by applicable law. (2) sending commercial communications, periodic notifications by email or SMS; (3) conducting market research, tracking and monitoring sales and customer/consumer behavior.
The Customer/User/Buyer agrees to provide MDL Luxury with unlimited access, in terms of volume and time, to any materials and information that they send to the Seller through or in connection with the Platform, regardless of whether they have placed an Order and completed a transaction through the Platform. MDL Luxury has no obligation to keep such information confidential, unless required to do so by applicable law.
By providing their data to MDL Luxury (including email), the Customer/User/Buyer gives their explicit consent for MDL Luxury or third parties, such as couriers, merchants, partners of MDL Luxury, and providers of marketing services, state, municipal, or non-governmental agencies or companies in the insurance or financial services sector, when required by specific legislation, as well as other companies with which MDL Luxury may develop joint programs for offering the Goods and/or Services on the market, etc.
Ordering items
CONCLUDING A CONTRACT
Items from the catalog can be ordered by selecting the option to visit the Website as a "guest" or a registered user.
When ordering goods displayed in the Website catalog, the Customer agrees to the Terms and Conditions of Use.
An "Order" is a request made by the customer to purchase specific items. The order is considered placed after the customer receives an automatic email with an order number. Orders are confirmed when the Customer receives a second automatic email with the number of the waybill with which the shipment is traveling. The seller is not liable to customers/users/buyers for the lack of current availability of a given item until the moment of confirmation.
Once logged into their Profile, the Customer can place an order for one or more items by selecting the color, size, and quantity of each item displayed in the catalog. Once all the options have been selected, the Customer adds the items to the Shopping Cart by clicking on the "Add to Cart" button. Once all the desired items have been added to the Shopping Cart, the Customer must select a payment method and a delivery address within the territory of the Republic of Bulgaria.
In the event of changes in the price list of the goods offered, the Seller reserves the right to cancel the orders placed, and is obliged to notify the Customer of the change and the current price of the item ordered by him.
Despite the efforts made by the Website team to keep stock levels up to date, the Customer agrees that differences between the stock levels shown at the time of ordering and the actual stock levels established after the order has been placed are permissible. In the event that the availability of one or more items in an order has been exhausted, the Seller undertakes to contact the Buyer using the details provided in the latter's Profile. In such circumstances, the Buyer may choose one of the following options:
In cases where goods ordered and purchased with a bank card are subsequently found to be out of stock, the amount of the missing item(s) will be refunded to the bank card used for payment.
The Customer agrees that saving the electronic address of a given item on the Website and/or saving it in the "Favorites" category does not guarantee the availability of the item or the period during which the item will be offered in the Website catalog. In connection with the above, the Customer agrees that items saved in the manner described will be removed from the Website catalog, and the status of such goods will be changed to "Inactive."
If a Customer orders an item whose status is "Inactive," the Seller has the right to automatically cancel the order. In such cases, the Seller undertakes to notify the Customer by sending an automatic message to the e-mail address specified by the latter in the registration form.
In the event of a systemic technical error in the price of an item, the Seller has the right to automatically cancel the order. In such cases, the Seller shall notify the Customer by sending an automatic message to the e-mail address provided.
Each order placed through the Website shall be considered a separate Distance Contract concluded between the Seller and the Buyer. For the avoidance of doubt, the Distance Contract shall be deemed concluded from the moment the order is sent to the Buyer.
Orders placed on weekends and holidays are processed on the first business day.
Payments
Goods ordered through the Website can be paid for in the following ways:
To avoid any doubts regarding the Customer's personal data, the Website does not store any information regarding the number and/or type of card used for the transfer. This information is processed solely by the server of the bank that provided the Virtual POS terminal.
Transportation
Goods purchased through the Website are delivered to the Buyer by the courier company "Speedy" AD.
The goods are sent to the Buyer only after the Seller has received confirmation of the order. After receiving confirmation from the Buyer, the Order is delivered as follows:
The following delivery methods are available:
For Orders worth less than BGN 99.00 (ninety-nine leva), the Customer shall use the Paid Delivery option at a cost of BGN 3.99.
For Orders worth more than BGN 99.00 (ninety-nine leva), the Customer can use the Free Delivery option.
Orders sent to an office will be held at the courier's office for no longer than 10 (ten) days. After this period, the Seller has the right to cancel the Order without expressly notifying the Customer.
For Orders made to an address, the Customer is obliged to provide access and the possibility to accept the Order. If the Customer is not found at the specified address, the Seller reserves the right to cancel the Order or leave it at the nearest courier office, where the goods will remain for no longer than 10 (ten) days, after which the Order shall be considered canceled and the goods returned to the Seller.
Goods ordered through the Website have a "Preview" option; if the order is canceled, the recipient is responsible for the return shipping costs.
Order cancellation and return of goods
For Customers who have refused to pay for an Order with cash on delivery more than twice, the Seller shall provide the option to purchase goods, but only on condition that the Customer pays for the goods via the Virtual POS terminal. If the Customer refuses to pay for the Order in this way, the Seller has the right to cancel the Order in question without expressly notifying the Customer.
Cancellation of an already confirmed Order by the Buyer shall be carried out in the following order:

The Buyer has the right to refuse the Order if the integrity of the packaging and the goods inside it have been damaged during transport. For the avoidance of doubt, if the integrity of the packaging has been compromised but no damage has been caused to the goods, the Buyer shall not be entitled to invoke this clause.
Goods may be returned to the Seller provided that they are in the same condition as when they were received (with all labels attached, without being torn and/or removed) and have not been treated with cleaning products (perfumes, detergents, etc.), contaminated, damaged, or used. Items worth more than BGN 200 may only be returned if the protective seal affixed by the Seller is present; if it is removed, the item cannot be returned.
For the avoidance of doubt, the Buyer has the right to return the goods no later than 14 days from the date of receipt of the Order, as specified in the Consumer Protection Act.
The terms and conditions for returning goods are in accordance with the requirements of the Consumer Protection Act.
With regard to goods sold by MDL Luxury, there is a legal guarantee of conformity in accordance with the rules of the Consumer Protection Act, which guarantee for individual types of goods is in line with the minimum guarantee periods that are valid for the respective type of goods within the European Union.
The seller is liable for any lack of conformity of the goods that exists at the time of delivery and becomes apparent within two years of delivery, but no later than 14 days after the non-conformity with the contract is established.
Buyers have the right to make complaints about purchased goods in accordance with the provisions of the Law on the Provision of Digital Content and Digital Services and on the Sale of Goods. Complaints regarding delivered goods are accepted by the Buyer on the SHOP MDL website, and the form is available at the following link or at any of the MDL Luxury stores in the country. The right to choose where to file a complaint belongs entirely to the consumer.
MDL Luxury maintains a register of complaints submitted to it in accordance with the requirements of the Consumer Protection Act and the Act on the Provision of Digital Content and Digital Services and the Sale of Goods.

The Seller reserves the right not to accept the return of swimwear, underwear, jewelry, perfumes, and eyewear and not to refund the amount paid by the Customer under Article 57 of the Consumer Protection Act. For the avoidance of doubt, in the event of a return by the Customer of swimwear, underwear, jewelry, and eyewear, the Seller undertakes to return the goods to the Buyer, with the transport costs being borne by the latter. When the consumer exercises their right to withdraw from the contract, they are liable for the reduced value of the goods caused by their testing, other than that necessary to establish the nature, characteristics, and functioning of the goods. When the consumer exercises their right to withdraw from the contract, they are liable for the reduced value of the goods caused by trying them on, other than what is necessary to establish their nature, characteristics, and proper functioning.
In connection with the return of goods to the Seller, the Customer must follow the procedure below and provide the following information:

The return of goods from the Buyer to the Seller shall be made by sending the goods by courier to the following address:

When returning the goods, the transport costs shall be borne by the Buyer. For the avoidance of any doubt, the return of goods to the Seller at the latter's expense shall be considered a breach of these GTC. For the avoidance of doubt, goods returned in this manner will be accepted by the Seller, who reserves the right, when refunding the amount to the Customer, to deduct the amount paid by the Customer for the transport costs of returning the goods.
Returning goods to the Seller using the "cash on delivery" option is considered a violation of these Terms and Conditions. For the avoidance of doubt, goods returned in this manner will not be accepted by the Seller until the "cash on delivery" option is removed.
With these "General Terms and Conditions," the Seller aims to inform the Buyer that, as a consumer, they have the option to contact their local ADR authority in relation to a dispute that they are unable to settle directly with the Seller.

ADR is a procedure for out-of-court settlement of domestic and cross-border disputes relating to contractual obligations arising from sales or service contracts between a trader established in the Union and a consumer residing in the Union, through the intervention of a dispute resolution body that offers or imposes a solution or brings the parties together to facilitate a mutually agreed solution.

Refund of paid amount
In case of order cancellation, the refund of the amount paid by the Buyer via bank card shall be made by the Seller only by bank transfer within 14 (fourteen) days from the date of the order.
In case of missing items from an Order, the refund of the amount paid by the Buyer via bank card shall be made by the Seller only by bank transfer within 14 (fourteen) days from the date of the order.
The Seller undertakes to refund the amount paid by the Buyer within 14 (fourteen) days from the date of the Buyer's request for return of the goods, by providing a document certifying its return to the Seller.
If the Order was paid by card through the Virtual POS terminal on the Website, the amount will be refunded to the card used for payment.
If the Order has been paid by cash on delivery, the amount will be refunded to the personal bank account specified by the Customer in Bulgarian leva.
In connection with the above, the Seller shall not be liable for any incorrectly submitted bank account details. The Seller's responsibility to refund the amount for a canceled order ends at the moment the bank transfer is made to the account specified by the Customer.
In cases where the Buyer has requested an invoice for a legal entity, the latter shall receive a credit note from the Seller.
